House Bill 817
House Bill 817, shepherded by Tracy King, Medina County representative, is a bill to stop TCEQ from permitting wastewater discharge into the Neuces River Basin. The bill has not been passed by the Texas legislator, however a resolution to support the bill was passed in Bandera county.
If the bill is passed by the Texas legislator, TCEQ will be prohibited from authorizing any applications for wastewater permits that would allow direct discharge into creeks in the upper Nueces River Basin. If the bill is passed, any permit application already accepted by at TCEQ such as the Torn’s would not be affected — only new applications. HOWEVER, this bill can be used as additional leverage to persuade the TCEQ against issuing the Torn's wastewater permit.
The bill was endorsed by Bandera County because wastewater discharge is detrimental to the health of our creeks. If the TCEQ accepts the Torn's application and issues the permit, and the bill is passed, they would be the ONLY people discharging wastewater into the creek.
